A Louisiana Trade Name Affidavit is a legal document required by the state of Louisiana for any business that wishes to operate under a trade name or “doing business as” (DBA) name. The affidavit must be filed with the Louisiana Secretary of State and can be used to register a single trade name or multiple trade names. A Louisiana Trade Name Affidavit is a sworn statement by the owner of the business that the trade name is being used in good faith, that the use of the trade name does not violate any state laws, and that the business is not attempting to mislead or deceive the public. The affidavit must also include the business name, the date of establishment, the name of the owner(s) of the business, and the address of the business. There are two main types of Louisiana Trade Name Affidavits: an Initial Trade Name Affidavit and an Amended Trade Name Affidavit. An Initial Trade Name Affidavit is used to register a new trade name with the state, while an Amended Trade Name Affidavit is used to make changes to an existing trade name registration. Both types of affidavits must be notarized before they can be filed with the Secretary of State.
