Louisiana Motion (To Withdraw Garnishment Deposit) is a legal document used when a creditor is attempting to recover a debt from a debtor through a wage garnishment. This motion is filed in the court where the garnishment was initiated, and it requests for the court to order the garnishee (the person or business holding the debtor’s funds) to release the funds to the creditor. The motion must include the debtor’s name and address, the garnishee’s name and address, the amount of money the garnishee is holding, and the reason for the request. There are two types of Louisiana Motion (To Withdraw Garnishment Deposit): Ex Parte Motion and Contested Motion. An Ex Parte Motion is used when the debtor does not oppose the creditor’s request, and the court grants the motion without a hearing. A Contested Motion is used when the debtor does oppose the creditor’s request, and the court requires a hearing before granting the motion.
