R.S. 46:2181 et seq., La. R.S. 9:372, La. R.S. 9:361 et seq., or La. C.C.P. Art. 3601) is a legal document that is filed when a person wishes to modify or dissolve an existing court order that was created to protect them from abuse. The Motion is typically filed by either the alleged abuser or the victim of abuse and is typically done in the district court of the parish where the order was originally issued. There are two types of Louisiana Motion to Modify or Dissolve Abuse Prevention Order that may be filed: 1. Motion to Modify — A motion to modify an existing order can be used when a person wishes to change the terms of the order, such as adding or removing restrictions on contact between the parties, or changing the duration of the order. 2. Motion to Dissolve — A motion to dissolve an existing order can be used when a person wishes to have the order completely terminated. This type of motion is typically filed when the parties involved have resolved their issues and no longer need the protection of the order. The motion must be filed with the court and include the necessary information such as the date the order was issued, the reason for the motion, and any evidence to support the motion. The court will then hold a hearing to determine whether to modify or dissolve the order.
