A Louisiana Motion to Modify or Dissolve Abuse Prevention Order, In Re convention (pursuant to La. R.S. 46:2131 et seq., La. R.S. 46:2151, La. Ch. C. Art. 1564 et seq., La. R.S. 46:2171 et seq., La. R.S. 46:2181 et seq., La. R.S. 9:372, La. R.S. 9:361 et seq., or La.) is a court filing by a respondent in a domestic abuse proceeding asking the court to modify or dissolve the existing protective order. In order to modify or dissolve the protective order, the respondent must show that the order is no longer necessary to protect the petitioner from domestic abuse. There are two types of Louisiana Motion to Modify or Dissolve Abuse Prevention Order: 1) Motion to Modify Protective Order and 2) Motion to Dissolve Protective Order. The Motion to Modify Protective Order seeks to modify the existing protective order so that the respondent can engage in certain activities that are normally prohibited. For example, the respondent may seek to modify the order to allow contact with the petitioner, or to modify the order to allow access to shared property or assets. The Motion to Dissolve Protective Order seeks to dissolve the order in its entirety. This is often done when the parties agree that the order is no longer necessary. In order to grant either of these motions, the court must be satisfied that the order is no longer necessary to protect the petitioner from domestic abuse.
