A Massachusetts Notice of Appeal is a legal document which is used to notify the court that an individual or organization wishes to appeal a decision made by a lower court or administrative tribunal. It is the first step in the appeals process and must be filed within 30 days of the judgment or decision being made. There are two types of Massachusetts Notice of Appeal: civil appeals and criminal appeals. In a civil appeal, a Notice of Appeal is filed when someone wishes to challenge a court order or decision that was made in a civil case. In a criminal appeal, a Notice of Appeal is filed when someone wishes to challenge a court order or decision that was made in a criminal case. The Notice of Appeal must be filed with the court where the original judgment or decision was made, as well as with the appellate court. The Notice of Appeal must include information about the appellant, the court being appealed to, the lower court or tribunal’s decision, and the grounds for the appeal.
