A Massachusetts Motion To Vacate Default Judgment (Remove Default) is a legal motion to set aside or rescind a default judgment against a defendant. It is a request to the court to undo a judgment that was entered against the defendant due to their failure to appear in court, file an answer, or otherwise defend against a lawsuit. This type of motion is sometimes referred to as a Motion to Set Aside Default Judgment or a Motion to Vacate Default Judgment. The motion must be made within a certain period of time (usually no more than one year) after the default judgment is entered. The defendant must provide a valid reason why the default judgment should be vacated and must also provide evidence to support their claim. There are two types of Massachusetts Motion To Vacate Default Judgment (Remove Default): a Motion to Vacate Default Judgment Based on Lack of Service and a Motion to Vacate Default Judgment Based on Excusable Neglect. A motion to vacate default judgment based on lack of service can be filed when the defendant was not properly served with the complaint or other court documents. A motion to vacate default judgment based on excusable neglect can be filed when the defendant failed to file a response or other court documents due to an excusable reason (e.g., illness, death in the family, etc.).
