Massachusetts Petition for Informal Probate of Will and/or Appointment of Personal Representative is a legal document used when an individual wishes to have a will informally probated by the court and/or to appoint a Personal Representative to administer the estate. This document must be filed in the court along with the original will and applicable affidavits. The types of Massachusetts Petition for Informal Probate of Will and/or Appointment of Personal Representative include Petition for Probate of Will, Petition for Appointment of Personal Representative, Petition to Revoke Letters of Administration, Petition to Establish Testamentary Trust, and Petition to Set Aside Will. The Petition is used to provide the court with the information necessary to determine the validity of the will, the identity of the Personal Representative, and the authority of the Personal Representative to act on behalf of the estate. The Petition must also include the name and address of the decedent, the names and addresses of the heirs and next of kin of the decedent, and the name and address of the proposed Personal Representative. Upon the court’s approval, the Personal Representative will be granted Letters Testamentary which will allow them to begin administering the estate.
