The Maryland Certification of Custodian of Records or Other Qualified Individual is a certification process in Maryland for individuals who are responsible for maintaining records for organizations, such as corporations, non-profit entities, and government agencies. This certification is required to ensure that records are properly safeguarded and maintained in accordance with state and federal laws. The certification is issued by the Department of Assessments & Taxation and is valid for three years. There are two types of certifications available: 1) Custodian of Records and 2) Other Qualified Individual. The Custodian of Records must have the primary responsibility for the maintenance of the records and must be knowledgeable in the organization’s record-keeping policies and procedures. The Other Qualified Individual must have sufficient knowledge and experience with record keeping and can be delegated to maintain records in the absence of the Custodian of Records. To obtain the certification, the individual must complete the application form and provide proof of identity. The application must also be accompanied by a surety bond in the amount of $2,500 and a fee of $50. Once approved, the certification will be issued and the individual must then maintain records in accordance with the Maryland Uniform Commercial Code and other applicable laws.
