A Maryland Counter-Complaint for Custody/Child Support is a legal document that is filed by a parent in response to a Complaint for Custody/Child Support. This document is used to counter the claims made by the other parent in the Complaint, and to establish a parent's rights to custody or child support. Depending on the circumstances, there are two types of Maryland Counter-Complaint for Custody/Child Support: (1) a Counter-Complaint for Custody and/or Visitation, and (2) a Counter-Complaint for Child Support. The Counter-Complaint for Custody and/or Visitation is used to establish the parent's rights to custody or visitation of a child, and it includes information about the parent's relationship with the child, the parent's ability to provide a stable home environment, the parent's involvement in the child's life, and the parent's reasons for wanting custody or visitation. The Counter-Complaint for Child Support is used to establish the parent's right to receive or pay child support, and it includes information about the parent's income, the child's needs, and the parent's reasons for seeking or opposing child support. Both types of Counter-Complaint for Custody/Child Support must be filed with the Circuit Court in the county where the Complaint was filed. Once the Counter-Complaint is filed, the court will schedule a hearing to determine the parties' rights and responsibilities regarding custody and/or child support.
