A Maryland Motion for Postponement is a type of legal document filed in Maryland's Circuit Court. It is used to request a postponement of a court date, either for a civil or criminal matter. Generally, a Maryland Motion for Postponement must be filed at least five days prior to a scheduled court date and must be served on all parties involved in the case. This motion must include a brief description of why the requested postponement is necessary, as well as a proposed new court date. The court will then review the motion and decide whether to grant or deny the postponement. There are two types of Maryland Motion for Postponement: the “Agreed Motion” and the “Unopposed Motion.” An Agreed Motion is one in which all the parties involved in the case agree to the postponement. An Unopposed Motion is when only one party files the motion, but the other parties do not object. In either case, the court must still review and approve the motion before a postponement is granted.
