A Maryland Affidavit of Service (Private Process) is a document used to prove that a legal notice was served in accordance with the Maryland Rules of Civil Procedure. It is a sworn statement from the individual who served the notice which must include the date, time, and manner of service. The affidavit must also identify the process server, the person or persons served, and the legal document served. There are two types of Maryland affidavits of service: 1. Private Process Affidavit of Service: This affidavit is used when the process server is a private individual, rather than a public official. This affidavit must be signed by the process server and notarized to be deemed valid. 2. Sheriff’s Affidavit of Service: This affidavit is used when the service is performed by a public official, such as a sheriff or constable. This affidavit must include the official’s signature, as well as the signature of the sheriff or constable who served the notice.
