The Maryland Petition for Termination of Guardianship of the Property is a legal document used when an individual, known as the petitioner, is seeking to end the legal guardianship of another individual over a minor child or another person's property. This document must be completed and filed with the appropriate court in order to end the guardianship. There are two types of Maryland Petition for Termination of Guardianship of the Property: Voluntary and Involuntary. A Voluntary Petition for Termination of Guardianship of the Property is used when the petitioner and the guardian have agreed to end the guardianship. The petition must be signed by both parties and include an explanation of why the guardianship is being terminated. An Involuntary Petition for Termination of Guardianship of the Property is used when the petitioner and the guardian have not agreed to terminate the guardianship. The petitioner must include an explanation of why the guardianship should be terminated, as well as evidence of the guardian’s neglect or incompetence. The Maryland Petition for Termination of Guardianship of the Property must be filed with the appropriate court and the petitioner must provide proof of service of the petition to the guardian. After the petition is filed, the court will hold a hearing to determine whether the petition should be granted or denied. If the petition is granted, the guardianship will be terminated and the petitioner will be able to take over the legal responsibility of the minor child or the property.
