Maryland Waiver of Bond is a form that is used when a defendant is released from custody without having to post a bail bond. The defendant agrees to appear at all scheduled court appearances in exchange for his or her release. The form is used by judges and bailiffs to document the defendant's agreement and to ensure that the defendant does not forfeit the bond. There are two types of Maryland Waiver of Bond: Personal Recognizance and Surety. A Personal Recognizance waiver allows the defendant to be released without having to post a bail bond. The defendant agrees to appear in court, or be subject to a penalty if they fail to do so. A Surety waiver requires the defendant to post a bail bond, which is typically secured by a third party such as a family member or a bail bondsman. The defendant must then appear in court, or risk losing the bond.
