Sec. 1035 is a state law that makes it a crime to knowingly and willfully make false or fraudulent statements when applying for a health care benefit, when obtaining health care benefits, or when making a claim for payment of health care benefits. The law addresses any false statements that are made to an insurance company, health care provider, or other third-party payer. The law also includes false statements made to the state or any of its political subdivisions, or to any other person in connection with the delivery of health care services or benefits. It is a Class D crime, punishable by up to 364 days in jail and/or a fine of up to $2,000.
