A Maine Petition for a Writ of Habeas Corpus Under 28 U.S.C. Sec. 2241 is a legal document used to challenge the legality of a person’s confinement in a state or federal prison. It is a request for the court to order the prison or jail to produce the prisoner and show cause why the prisoner should not be released or released on bail. In Maine, a habeas corpus petition must be filed in the United States District Court for the District of Maine. There are two types of Maine Petition for a Writ of Habeas Corpus Under 28 U.S.C. Sec. 2241: a First Petition and a Second or Successive Petition. A First Petition is one that is filed for the first time and must be based on a claim that the petitioner's custody is in violation of the Constitution or laws of the United States.
