The Maine Guardianship Plan is a legal process that provides an individual or family with the authority to make decisions on behalf of an incapacitated adult or minor child. Guardianship is designed to ensure that the best interests of the individual are met in matters relating to health, safety, and welfare. The Maine Guardianship Plan is managed by the Office of the Public Guardian and applies to all Maine residents. The plan provides three types of guardianship: 1. Plenary Guardianship: This type of guardianship grants the guardian full authority to make decisions on behalf of the incapacitated individual. 2. Limited Guardianship: This type of guardianship grants the guardian limited authority to make decisions on behalf of the incapacitated individual. 3. Emergency Guardianship: This type of guardianship is granted on an emergency basis in cases where the individual's health or safety may be in danger. The Maine Guardianship Plan also provides for the appointment of a guardian ad item, who is an advocate for the individual in guardianship proceedings. The plan is also administered by the Office of the Public Guardian, which provides support to guardians throughout the guardianship process.
