Description

This form is used by a Landlord to demand payment of overdue rent from a non-residential tenant within 7 days from giving the Notice in accordance with state law. (Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Non-Residential" includes commercial, industrial, etc. property. If the Tenant fails to pay within 7 days, the lease may be considered terminated by the Landord. The Tenant is informed that the Tenant must either pay the rent or suffer possible termination. If he does not pay the Landlord may begin eviction proceedings. If the Landlord does not elect to proceed with termination or eviction but instead agrees to accept rent after the termination date stated in the Notice, the lease is generally reinstated. In the state of Michigan, this costs $45 in filing fees. If a money judgment is requested (such as past-due rent or money to pay for damages to the rental unit), an additional filing fee of $25-$150 will be added, depending on the amount of money the landlord is requesting from the tenant.

Be signed. The notice must then be served on the tenants either by delivering it in person or by having it delivered by registered or certified mail. A fixed term tenancy is automatically terminated on the date specified in the residential tenancy agreement. The landlord and tenant can agree to end the lease early.

You can't just kick her out but you can legally evict her the same as you would any other unwanted tenant. I have attached a copy of a Michigan Landlord/Tenant Guide which has some of the forms you would use.

Be in writing. Be addressed to the tenant. Describe the rental property, usually by giving the address. Give the reason for the eviction. State how much time the tenant has to fix the problem, if there is one. Include the landlord's address and the date of the notice.

In the case of month-to-month leases, or if the tenant doesn't have a lease, then the landlord must give one rental period's notice before filing to evict. The next step is to prepare a summons and complaint, then file it in the district court where the dwelling is located.

Once you get a demand for possession, you have seven days to pay the rent or move out. If you don't do either one, your landlord can start an eviction case against you. A landlord starts an eviction case by filing a summons and complaint with your local district court.

Eviction begins when the parents fill out two copies of Michigan Form DC 100c, Notice to Quit to Recover Possession of Property. The parents fill out one and give it to the child and keep one for their own records. This notice must be delivered to the adult child or to another adult resident who can pass it on.

Putting all this together, you can see that even if the tenant does not show up to contest the eviction hearing, it will take an absolute minimum of four weeks to get an eviction in Michigan. In reality, an official eviction is likely to take longer, in the region of six to eight weeks.
