The Minnesota Order Granting Relief From Stay (post-discharge) is a court order issued by a bankruptcy court after the discharge of a debtor's case. It allows creditors to act against the debtor or the debtor's property by either pursuing collection of a debt or foreclosing on a mortgage loan. This order is also referred to as a “relief from stay” order or a “lift of stay” order. The order is issued after a debtor has completed all the required obligations of the bankruptcy process (filing the petition, attending the 341 hearing, and completing the post-discharge requirements). There are two different types of Minnesota Order Granting Relief From Stay (post-discharge): a general order and a limited order. A general order grants relief from stay for all creditors. A limited order grants relief from stay to only certain creditors, usually those with secured or priority claims. Both types of orders are effective immediately upon issuance.
