Minnesota Instructions — Affidavit of Diligent Efforts and Order for Service by Publication is a document used in the state of Minnesota to serve legal papers to a person who cannot be found. This affidavit and order are used in cases where the defendant is unable to be served with process in the usual way, such as when the defendant has moved away, cannot be located, or is avoiding service. This document states that the plaintiff has made a diligent effort to locate and serve the defendant and has been unsuccessful. There are two types of Minnesota Instructions — Affidavit of Diligent Efforts and Order for Service by Publication: 1) Private Affidavit and Order, and 2) Court Affidavit and Order. The Private Affidavit and Order is used when the plaintiff is not a party to a court action and is seeking legal service on their own behalf. The Court Affidavit and Order is used when the plaintiff is a party to a court action and is seeking service of process pursuant to a court order. Both documents must be completed and submitted to the court in order to be effective.
