The Minnesota Notice of Hearing and Notice of Rights (Regarding Emergency Guardian or Conservator) is a document issued by a Minnesota court when a petition is filed to appoint an emergency guardian or conservator. It contains information about the rights that the proposed conservative or ward has in Minnesota, as well as the hearing date, time, and location where the court will consider the petition. The Notice of Hearing and Notice of Rights must be served on the proposed conservative or ward at least 14 days prior to the hearing. There are two types of Minnesota Notice of Hearing and Notice of Rights: one for emergency guardianship cases and one for emergency conservatorship cases. The Notice of Hearing and Notice of Rights informs the proposed conservative or ward of their right to be present at the hearing, to be represented by an attorney, to present evidence and testimony, and to cross-examine witnesses. It also outlines the consequences of not appearing at the hearing, such as a default judgment being entered against the proposed conservative or ward.
