Description

Petition For Emergency Relief Under Tenant Remedies Act

The Minnesota Petition For Emergency Relief Under Tenant Remedies Act (MT ERA) is a state law that provides protections to Minnesota tenants. It provides tenants with the right to file a petition for emergency relief if they are facing an emergency situation such as a threat of eviction, a threat of utility shutoff, or a threat of health and safety hazards in their rental unit. If the tenant is able to prove that they are facing an emergency, the court can issue an order to prevent eviction or shutoff of utilities, or require the landlord to make repairs or take other action to address the health and safety hazards. The Minnesota Petition For Emergency Relief Under Tenant Remedies Act has two main types: 1. Temporary Restraining Order (TO): A TO is an order issued by a court that temporarily prevents a landlord from taking action against a tenant, such as evicting them or shutting off their utilities. 2. Permanent Injunction: A permanent injunction is an order issued by a court that permanently prevents a landlord from taking action against a tenant, such as evicting them or shutting off their utilities.

Ending the Lease If a month-to-month lease does not include specific provisions for notifying the landlord, you must notify the landlord, at least one full rental period before the last rent payment is due, that you plan to end the lease.
