The Missouri Mesothelioma Liability Election of Self-Insured Employer or Group Trust Member Pursuant to 287.200.4(3), RSM is a process by which employers in the state of Missouri can elect to insure themselves and/or become members of a group trust for liability coverage in the event of a claim for damages due to mesothelioma. This election must be filed with the State of Missouri within a certain period of time, and must include proof of financial responsibility, such as a bond or letter of credit. There are two types of Missouri Mesothelioma Liability Election of Self-Insured Employer or Group Trust Member Pursuant to 287.200.4(3), RSM: Self-Insured Employer and Group Trust Member. For Self-Insured Employer, the employer must provide proof of financial responsibility to the State of Missouri in an amount at least equal to the total projected liability for mesothelioma claims. For Group Trust Member, the employer must provide proof of financial responsibility to the State of Missouri in an amount equal to the proportion of the total projected liability for mesothelioma claims applicable to the member.
