The Missouri Affidavit of Compliance with Prevailing Wage Law is an affidavit submitted by contractors to the Missouri Department of Labor and Industrial Relations (DOLOR) to certify that they are in compliance with Missouri’s prevailing wage law. This affidavit is required for any contractor or subcontractor who will perform services for a public works project in the state of Missouri. The prevailing wage law establishes the minimum rate of pay for each occupation included in the project. There are two types of Missouri Affidavit of Compliance with Prevailing Wage Law: the Standard Affidavit and the Special Affidavit. The Standard Affidavit is required for all public works projects that exceed $75,000 in total value. The Special Affidavit is required for public works projects that exceed $500,000 in total value. Both affidavits must be completed and submitted to the DOLOR before the project can begin. The affidavit must include the contractor’s name, the name of the public works project, the prevailing wage rates for each occupation, and the contractor’s assurance that they will pay the required prevailing wage rates. The contractor must also provide a list of all subcontractors, subcontractor employees, and any other personnel that will be used in the project. Upon completion of the project, the contractor must submit a Final Certificate of Compliance with Prevailing Wage Law to the DOLOR. This document certifies that the contractor has paid the required prevailing wage rates for each occupation included in the project. Failure to comply with the Missouri prevailing wage law can result in penalties, including fines and debarment from future public works projects.
