Description

Pursuant to this Agreement, Broker intends to refer to a corporate entity potential purchasers of real property. In return for referring potential purchasers to said corporate entity, it agrees to pay to Broker a referral fee under and upon the terms and conditions set forth in this Agreement.

Missouri Broker Referral Agreement is a legal contract that outlines the terms and conditions under which a real estate broker refers a potential client or customer to another broker or real estate agent in exchange for a referral fee. This agreement is commonly used in the state of Missouri when one broker wishes to refer clients to another broker who possesses the necessary skills, expertise, or geographical knowledge to better serve the client's needs. The Missouri Broker Referral Agreement typically includes various key components such as the names and contact information of both brokers involved, the effective date of the agreement, and a detailed description of the referral process. It also outlines the scope of the referral and any restrictions or limitations placed on the referring broker. There are different types of Missouri Broker Referral Agreements that can be categorized based on various factors: 1. Residential Broker Referral Agreement: This type of agreement is specific to residential real estate transactions. It allows a broker to refer potential buyers or sellers to another broker who specializes in residential properties. The referring broker typically earns a referral fee when the referred client successfully completes a transaction. 2. Commercial Broker Referral Agreement: Similar to the residential agreement, this type is designed for referrals related to commercial real estate transactions. It enables a broker to refer clients interested in leasing, buying, or selling commercial properties to another broker with expertise in the commercial real estate market. 3. Exclusive Broker Referral Agreement: In some cases, brokers may opt for an exclusive referral arrangement. This type of agreement restricts the referring broker from referring clients to any other broker or agent apart from the one mentioned in the agreement. It ensures the referring broker receives a set referral fee for any and all referrals made during the agreed-upon period. 4. Non-Exclusive Broker Referral Agreement: Unlike the exclusive agreement, this type allows the referring broker to refer clients to multiple brokers or agents at the same time. The referring broker may negotiate different referral fees depending on the specific referral and may have more flexibility in choosing the most suitable recipient broker for each referral. In summary, the Missouri Broker Referral Agreement is a legally binding contract that governs the referral of potential clients or customers from one broker to another in the state of Missouri. Its purpose is to establish the terms of the referral process and ensure fair compensation to the referring broker. Various types of these agreements exist, including residential, commercial, exclusive, and non-exclusive, providing flexibility for brokers to structure their referral arrangements to best suit their business needs.

It can work very well with new partners who might not be familiar with it as they would be in a unique situation if they do contract with you.  The only other way to implement one will be to take an existing marketing organization that has signed a contract or written agreement, but it is very expensive and difficult to establish because of its lengthy length.  What is special about this agreement is that it is very similar to a service agreement you would sign with an attorney to handle your business.  You do not need a license to create your own contract, but if you would like to enter into a service agreement you can always request one from a lawyer.  All you have to keep in mind is that if you do enter into a service agreement with your own attorney you must have the full right to enter into the terms and conditions of the agreement.  This agreement may look similar, but the wording in this agreement is different and more complex like a license agreement.
