Mississippi Order Partially Avoiding Lien (MORAL) is a state court order that allows a lender to partially avoid a lien on a property in Mississippi. The order is used to allow a lender to reduce a lien or other encumbrance on the same property that has already been recorded in the county records. MORAL applies to real property liens created by a deed of trust, mortgage, or other lien instrument. The order requires the lender to provide notice to any other liens or encumbrances on the same property and to post a copy of the order at the county courthouse. The order also requires the lender to file a copy of the order in the office of the Chancery Clerk. The two types of Mississippi Order Partially Avoiding Lien are Unilateral and Bilateral. Unilateral MORAL applies when a lender is the only one seeking to partially avoid the lien on the property. Bilateral MORAL applies when two or more lenders are seeking to partially avoid liens on the same property. The order must be agreed to by all parties in order to be effective.
