Montana Mont. LBF 19. CHAPTER 13 PLAN [MONT. LB 9009-1(b)] is a type of bankruptcy filing that allows debtors to reorganize their debts into a repayment plan that is approved by the bankruptcy court and administered by a court-appointed trustee. The plan must be accepted by the majority of the debtor's creditors and must meet specific criteria set forth in the Montana Code of Civil Procedure. Under this plan, the debtor agrees to make payments to the court-appointed trustee who then distributes the payments to the creditors in accordance with the terms of the repayment plan. Depending on the debtor's financial situation, the repayment plan could last from three to five years. There are two types of Montana Mont. LBF 19. CHAPTER 13 PLAN [MONT. LB 9009-1(b)]: the Wage Earner Plan and the Self-Employed Plan. The Wage Earner Plan is for those debtors who have a regular source of income, such as a salary or wages, and who can make regular payments to the trustee. The Self-Employed Plan is for those debtors who do not have a regular source of income and who cannot make regular payments. Under this plan, the debtor must propose a repayment plan based on their projected future income.
