The North Carolina Certification of Exigent Circumstances is a certificate issued by the North Carolina Department of Public Instruction (DPI) for educational institutions and school districts that have experienced an extreme financial hardship or emergency. It is used to temporarily waive certain state laws or regulations that would otherwise prohibit or impede the institution or school district from providing educational services during the declared exigent circumstance. There are two types of North Carolina Certification of Exigent Circumstances: (1) Financial Exigency Certification, which is issued when a school is facing financial insolvency, and (2) Emergency Certification, which is issued when an extraordinary event or circumstance threatens the health or safety of students, staff, and/or property. The North Carolina Certification of Exigent Circumstances must be applied for and approved by the DPI prior to the implementation of any waiver or exemption.
