Landlords can no longer issue a blanket ban on tenants having pets. Instead, under the government issued model tenancy agreement, the default position on rental property and pets is that a landlord will rent to tenants with pets.

Landlords can still stop tenants from keeping pets but must offer a reasonable excuse for refusal in writing within 28 days of the tenant's request.

Under the new Model Tenancy Agreement, announced by Housing Minister Rt Hon Christopher Pincher MP, landlords will no longer be able to issue blanket bans on pets by default.

Do landlords have to accept pets? 'The short answer is yes unless they have a very good reason not to,' says Vince Courtney, group lettings director at Andrews Property Group. 'Renting with pets has often been an emotive topic and it can cause tensions between landlords and tenants.

Does no pets include caged animals? Typically a no pets clause do include caged animals. This will be at the discretion of each landlord but in most cases, a landlord will have a zero pets policy across the board regardless of if the pet lives in a cage or not.

A provision in a tenancy agreement prohibiting the presence of animals in or about the residential complex is void. This means that any tenancy agreement provided to you that prohibits animals in your living space, is void. In other words, a landlord cannot refuse your pets in Ontario. This law is current as of 2021.

Model tenancy agreement changed to allow renting with pets If a landlord doesn't want their tenant to have a pet, they must object in writing within 28 days of a written request from the tenant. The landlord must provide a good reason, such as in smaller properties where owning a pet would be impractical.

In January 2021 the government made it easier for tenants to rent with pets by publishing a new standard tenancy agreement. This agreement helps pet owners through pet friendly provisions in the new standard tenancy agreement. Landlords can no longer issue a blanket ban on tenants having pets.

Alongside the proposed bill, the Ministry of Housing updated their standard tenancy agreement so that landlords cannot issue a 'blanket ban' on pets. Allowing pets is now the default position on the government's recommended model tenancy agreement.
