Nebraska Notice of Small Claims Proceeding (Service by Publication) is a legal notice published in a newspaper or public publication that alerts a defendant that a lawsuit has been filed against them. This process is used when the defendant cannot be located and served with the complaint and summons in person or by mail. In Nebraska, the Notice of Small Claims Proceeding (Service by Publication) is used when a defendant lives outside the state, or when their whereabouts are unknown. This notice must be published once a week for three consecutive weeks and must include the plaintiff’s name, the defendant’s name, the date and place of the hearing, and the legal cause of action. There are two types of Nebraska Notice of Small Claims Proceeding (Service by Publication): Service by Publication of Summons and Service by Publication of Notice. Service by Publication of Summons is used when the plaintiff is seeking monetary damages, while Service by Publication of Notice is used when the plaintiff is seeking a court order or some other type of relief.
