Nebraska Temporary Delegation of Parental Powers (NSDAP) is a legal process in which a parent temporarily transfers the parental rights and responsibilities of a minor child to a responsible adult. It is a way for parents to provide care for a child without having to go through the more complicated legal process of guardianship. NSDAP is an alternative to guardianship that is used when the parent or legal guardian of a minor child is unable or unavailable to provide care for the child due to illness, travel, or other temporary circumstances. The responsible adult does not have any legal authority over the child, but they can make decisions regarding the child’s care while the parent or legal guardian is away. There are two types of Nebraska Temporary Delegation of Parental Powers: Limited TDP and Full TDP. Limited TDP allows the responsible adult to make decisions regarding the care of the child, but the parent or legal guardian retains the right to make the final decisions. Full TDP gives the responsible adult full parental responsibility and authority for the care of the child, including the right to make binding decisions. In both cases, the parent or legal guardian must sign a document that outlines the terms of the delegation.
