New Hampshire LBF 4003-2A Motion to Avoid Lien Pursuant to 11 U.S.C. Sec. 522(f)(2) is a motion used in Chapter 7 bankruptcy cases in the state of New Hampshire. This motion allows a debtor to request the court to remove or "avoid" a lien on the debtor's property that has been granted under the Bankruptcy Code pursuant to 11 U.S.C. Sec. 522(f)(2). There are two types of motions available under this section: (1) Motion to Avoid Judicial Lien and (2) Motion to Avoid Non-Judicial Lien. The Motion to Avoid Judicial Lien is used to remove a lien that has been granted by a court, such as a judgment lien, a lien for unpaid taxes, or a lien for unpaid child support. The Motion to Avoid Non-Judicial Lien is used to remove a lien that has been granted outside a court, such as a lien for unpaid taxes, a lien for unpaid homeowner's association dues, or a lien for unpaid mechanics' liens. In order to be successful, the debtor must prove that the lien impairs an exemption to which the debtor is entitled under the Bankruptcy Code. If the debtor is successful in avoiding the lien, the lien will no longer be enforceable against the debtor's property. Keywords: New Hampshire LBF 4003-2A Motion, Bankruptcy Code, 11 U.S.C.
