A New Jersey Order to Avoid Liens In A Chapter 13 Case is a court order issued by the Bankruptcy Court to prevent creditors from claiming a lien on the debtor’s property. This order is available to all Chapter 13 debtors in the state of New Jersey. This order allows the debtor to keep their property, while repaying creditors in a three to five year repayment plan. The Order to Avoid Liens prevents creditors from attaching liens to the debtor’s property and prevents them from seizing or selling the debtor’s assets to satisfy their debts. There are two types of New Jersey Order to Avoid Liens In A Chapter 13 Case: Partial Avoidance and Full Avoidance.
