New Jersey Voluntary Binding Arbitration — Civil Action Consent Order of Dismissal is a legal document which is used to resolve a civil dispute outside of court by using binding arbitration. A binding arbitration is a process where the parties agree to submit the dispute to an independent arbitrator who will make a legally binding decision on the matter. The Consent Order of Dismissal is a document that is signed by both parties, which acknowledges that the dispute has been settled through binding arbitration and that the parties agree to abide by the arbitrator’s decision. There are two types of New Jersey Voluntary Binding Arbitration — Civil Action Consent Order of Dismissal. The first type is a “Compromise and Settlement” Consent Order of Dismissal, which is used when both parties agree to the terms of the settlement and are willing to accept the arbitrator’s decision. The second type is a “Contested Consent Order of Dismissal”, which is used when one or both parties are not willing to accept the arbitrator’s decision and the matter is brought to court.
