Bail reform was championed by Governor Chris Christie (a former United States Attorney) and Chief Justice Stuart Rabner (a former Attorney General of New Jersey and federal prosecutor). The bail reform statute was passed by the legislature and signed into law.

Eight years ago, then-Republican Gov. Chris Christie teamed up with Democrats to pass a major overhaul of New Jersey's criminal justice system, ushering through legislation that made the state among the first in the nation to effectively eliminate cash bail. There was little political uproar.

Following bipartisan legislation and a constitutional amendment supported by 62% of voters, New Jersey essentially eliminated cash bail and instituted a risk assessment approach in which judges consider community safety and other factors before deciding whether to detain or release someone before trial.

Now, 10 years later, there is strong evidence that bail reform has succeeded in dramatically reducing the number of people in jail while maintaining community safety. Prior to bail reform, around 15,000 New Jerseyans were incarcerated on any given day, with more than 75% just awaiting trial or sentencing.

Following a ballot question that was approved in the November 2014 general election, the New Jersey Constitution, article I, section 11, was amended (the Amendment) to substantially eliminate bail for defendants awaiting trial; the Amendment instead substituted a risk-based provision.

The New Jersey Criminal Justice Reform Act of 2017, more commonly referred to as bail reform, enacted a historical first for New Jersey. Pursuant to the Act, judges are empowered to order the detention of any individual they deem truly dangerous or at risk of flight.
