A New Jersey Notice of Motion is a court document that is filed to request an order from the court. This order can be anything from a request for a temporary restraining order (TO) to a request for a judgment on the merits. Generally, a Notice of Motion must include the name of the court, a statement of the relief being sought, the time and place the motion will be heard, a description of the papers or evidence to be presented to the court, and the name of the person or party the motion is being made against. The Notice of Motion must also be served on the responding party in order for it to be considered by the court. There are two main types of New Jersey Notice of Motion: the Uncontested Motion and the Contested Motion. An Uncontested Motion is a motion that is not opposed by the responding party. This type of motion can be granted by the court without a hearing, as long as the notice of motion is properly served on the responding party. A Contested Motion is a motion that is opposed by the responding party. This type of motion requires a hearing in order for the court to render a decision.
