New Jersey Pre-Trial Memorandum is a form used in the state of New Jersey to document any pre-trial agreements between the prosecution and defense. It is used to detail the stipulations of the agreement, including what charges are being dropped, what sentences are being recommended, and any other details of the agreement. There are two types of Pre-Trial Memorandum, a Plea Agreement and a Dismissal Agreement. A Plea Agreement is used when the defendant pleads guilty to a certain crime in exchange for a lesser sentence or certain terms of probation. A Dismissal Agreement is used when the prosecution agrees to drop certain charges in exchange for the defendant pleading guilty to a lesser charge. Both of these agreements must be approved by the court before they can take effect.
