There are two different types of Nevada Standard Discovery Plan or Request for Waiver of Filing Discovery Plan: an Optional Discovery Plan and a Mandatory Discovery Plan. The Optional Discovery Plan is used when the parties are able to negotiate and agree upon their own discovery plan. It sets out the types of discovery to be exchanged, the timeline for exchange, the parties responsible for exchange, and any other relevant information. The Optional Discovery Plan is not mandatory and is only used when the parties agree to it. The Mandatory Discovery Plan is used when the parties are unable to negotiate and agree upon their own discovery plan. It is mandatory and sets out the types of discovery to be exchanged, the timeline for exchange, the parties responsible for exchange, and any other relevant information. The Mandatory Discovery Plan is generally used when the parties are unable to agree on the terms of the Optional Discovery Plan. The Nevada Standard Discovery Plan or Request for Waiver of Filing Discovery Plan can also be used to request a waiver of filing a discovery plan. This request is used when one or more parties believe that a discovery plan is unnecessary and seek to have the court waive the requirement. The request must be accompanied by a showing of good cause as to why the discovery plan should be waived.
