A Nevada Assignment of Mark is a document created to transfer a trademark or service mark from one person or entity to another. The Nevada Assignment of Mark document is filed with the Nevada Secretary of State and is used to show that a transfer of ownership has taken place. There are two types of Nevada Assignment of Mark: voluntary and involuntary. A voluntary assignment of mark is when the transfer of ownership is done by agreement, between two parties, and is not forced by a court order. An involuntary assignment of mark is the transfer of ownership which is ordered by a court, and is usually done as part of an enforcement action. The Nevada Assignment of Mark document must include the assignor's (person or entity transferring the mark) name and address, the assignee's (person or entity receiving the mark) name and address, the mark which is being transferred, and the date of the assignment. The document must be signed by the assignor, and notarized and filed with the Nevada Secretary of State. Once filed, the assignment will be recorded and become part of the public record.
