The New York Waiver of Process Renunciation Or Consent To (Guardianship) (Standby Guardianship) is a legal document that allows a parent or guardian to voluntarily consent to the appointment of a standby or permanent guardian, for a minor or incapacitated adult, in the event of their death or incapacity. This document allows the court to appoint a guardian for the minor or incapacitated adult without a full hearing or court intervention, as long as all the necessary criteria have been met. There are two types of New York Waiver of Process Renunciation Or Consent To (Guardianship) (Standby Guardianship): Permanent Guardianship and Standby Guardianship. Permanent Guardianship is an irrevocable designation of a legal guardian for a minor or incapacitated adult. This type of guardianship is usually established when the parent or guardian is unable to care for the minor or incapacitated adult due to death or incapacity. Standby Guardianship is a temporary guardianship that is put in place when a parent or guardian is unable to care for the minor or incapacitated adult due to illness, travel, or other short-term circumstances. The standby guardian is appointed until the parent or guardian is able to resume care of the minor or incapacitated adult. The New York Waiver of Process Renunciation Or Consent To (Guardianship) (Standby Guardianship) document must be signed by the parent or guardian, and it must be witnessed by two individuals who are not related to the minor or incapacitated adult. The document must also be filed with the court in order to be valid.
