A New York Notice of Claim is a document that must be filed with a local government agency in New York State when someone intends to bring a lawsuit against the agency. It is generally required for any lawsuit seeking damages from a public entity, such as a city, town, village, county, or school district. The purpose of the Notice of Claim is to provide the public entity with notice of the legal action being taken against it and to provide the public entity with an opportunity to investigate the claim before a lawsuit is filed. There are two types of New York Notice of Claim: General Notice of Claim and Special Notice of Claim. A General Notice of Claim must be filed in all cases where damages are being sought from a public entity, including negligence, personal injury, property damage, and breach of contract. A Special Notice of Claim is required for cases involving medical malpractice. Both types of Notice of Claim must be filed within 90 days of the date of the incident or discovery of the injury or damage.
