A New York Petition (Discontinuance of Treatment) is a legal document which a person may file in order to request that a medical provider cease providing medical treatment. This petition is typically used in cases where a patient is in a persistent vegetative state or otherwise terminally ill, and in situations where the patient or their legal representative believes the continuation of medical treatment is no longer in the patient's best interest. There are two types of New York Petition (Discontinuance of Treatment): the first is a Petition for Appointment of a Health Care Agent to Withdraw Life-Sustaining Treatment, and the second is a Petition for Discontinuance of Treatment. The former allows the patient's designated health care agent to withdraw life-sustaining treatment with the consent of a court, while the latter requests that a court approve the discontinuance of medical treatment. Both petitions must be accompanied by a medical affidavit from a physician stating that the patient's condition is considered terminal and that the continuation of medical treatment is no longer in the patient's best interests.
