New York Petition Termination of Placement is a legal process for ending the placement of a child in a foster home or other out-of-home placement. This process allows a child's legal guardian to request that the child be removed from its current living environment and be returned to the legal guardian's home. The petition must be filed in the family court in the county where the child is currently placed. There are three types of New York Petition Termination of Placement: voluntary termination, termination by agreement, and termination by court order. Voluntary termination is when the child and/or the legal guardian voluntarily requests the termination. Termination by agreement is when the legal guardian and the agency that placed the child agree to the termination. Termination by court order is when the court grants a termination of placement, usually due to a hearing that is held to determine the best interests of the child.
