The New York Affidavit of Facts by Original Creditor is a document used to verify the truth of a debt or other account obligation. It is most often used in legal proceedings or debt collection proceedings, such as in a lawsuit or in a bankruptcy case. The document is signed by the creditor and states facts related to the account in question, such as the amount owed, the date the debt was incurred, the original creditor, and other pertinent information. The affidavit is sworn to under penalty of perjury by the creditor. There are three types of New York Affidavit of Facts by Original Creditor: 1. Affidavit of Fact for Judgement: This is used when the creditor is seeking a judgement against the debtor. 2. Affidavit of Fact for Collection: This is used when the creditor is seeking to collect a debt from the debtor. 3. Affidavit of Fact for Bankruptcy: This is used when the creditor is seeking to recover a debt from a debtor who has filed for bankruptcy.
