New York Order (Drug and Alcohol Testing) is a mandated drug and alcohol testing program for individuals arrested in the state of New York. This program is required for all individuals arrested in New York and is administered by either the New York State Department of Motor Vehicles or the arresting law enforcement agency. The program is designed to determine whether an individual has consumed alcohol or drugs prior to their arrest and to ensure that appropriate treatment is offered for those individuals who test positive for drugs or alcohol. There are two types of New York Order (Drug and Alcohol Testing) programs: immediate testing and deferred testing. Immediate testing is conducted immediately after the arrest, usually within 24 hours, and the results are immediately available. Deferred testing is conducted at a later date and the results are available within a few days. Both types of testing use breathalyzers, urine tests, and hair follicle tests to detect the presence of drugs or alcohol in an individual. In addition, New York Order (Drug and Alcohol Testing) includes mandatory counseling and education sessions that an individual must attend if they test positive for drugs or alcohol.
