New York Motion to Modify Placement (PINS) is a legal motion filed by a parent or guardian of a child in order to change the child's current placement with a public agency, such as a family court or a child welfare agency. This motion is used to modify a child's placement from a residential facility to a less restrictive setting, or to a more restrictive setting if a child's current placement is not appropriate. The PINS motion can also be used to request that a child be placed in a foster home or with a relative. There are two types of New York Motion to Modify Placement (PINS): an Emergency PINS Motion and a Non-Emergency PINS Motion. An Emergency PINS Motion must be filed if the child is in immediate danger or if the child's current placement is likely to cause significant harm. A Non-Emergency PINS Motion is used when the child's current placement is not appropriate, but the child is not in immediate danger.
