The New York Administrative Order re Mandatory Mediation Pilot Project is an initiative of the New York State Unified Court System that seeks to encourage the resolution of civil court cases through mediation. The project began in January 2019 and is set to run until December 2021. The project applies to civil court cases in the Supreme Court, the Civil Court of the City of New York, the Surrogate's Court, and the Family Court of the City of New York. It requires that all parties in a civil court case participate in mandatory mediation before the case is heard by a judge. The goal of the project is to reduce the backlog of cases in the court system, improve the quality of justice, and promote the use of alternative dispute resolution in civil cases. The New York Administrative Order re Mandatory Mediation Pilot Project includes three types of mandatory mediation: Early Mandatory Mediation (EMM), Promotion Conference Mandatory Mediation (PM CMM), and Combined Mandatory Mediation (CMM). Under EMM, parties to a dispute must participate in mediation before they can file a motion with the court. PM CMM requires parties to mediate before attending a pre-motion conference. CMM combines EMM and PM CMM, and requires parties to mediate before filing a motion and before attending a pre-motion conference.
