The affidavit serves as an assurance that the structured settlement annuitant is properly represented and that the structured settlement annuity was purchased from a qualified financial institution. There are two types of New York Broker's Affidavit for a Structured Settlement: the Qualified Broker's Affidavit and the Non-Qualified Broker's Affidavit. The Qualified Broker's Affidavit is used when the broker is registered with the New York State Department of Financial Services and is a member of National Association of Structured Settlement Planners or other organizations that are approved by the Department of Financial Services. The Non-Qualified Broker's Affidavit is used when the broker is not registered with the New York State Department of Financial Services.
