The New York Statement of Claim (Commercial Claims) is a legal document that is used in New York State to file a claim for money or damages due to breach of contract or other commercial disputes. It is also referred to as a “demand for payment” or “demand for judgment.” The statement must be filed in the Supreme Court or the County Court in the county in which the defendant resides. It details why the plaintiff believes he or she is entitled to receive the money or damages, as well as the amount desired. There are several types of New York Statement of Claim (Commercial Claims). These include breach of contract claims, collection claims, fraud claims, and unjust enrichment claims. Each type of claim requires different evidence and documentation in order to be successful. Furthermore, the amount of damages requested must be calculated correctly in order to be approved by the court.
