New York Estate Tax Power of Attorney is a legal document that allows a person to appoint an agent or attorney-in-fact to act on their behalf for the specific purpose of filing and paying New York estate taxes. The agent or attorney-in-fact is authorized to collect, examine, and verify information and documents necessary to file the appropriate returns; to pay taxes, including estimated taxes; to represent the taxpayer in all matters before the New York State Department of Taxation and Finance; and to perform all other acts necessary and proper to file and pay taxes. There are two types of New York Estate Tax Power of Attorney: general and limited. A General Power of Attorney grants the agent or attorney-in-fact broad powers to act on the taxpayer’s behalf, while a Limited Power of Attorney grants the agent or attorney-in-fact specific powers to act on the taxpayer’s behalf. In either case, the taxpayer retains ultimate control and responsibility for filing and paying taxes.
