There are two types of New York Packet for Dispute over Refund: the Standard Packet and the Business Packet. The Standard Packet is used to dispute a refund for an individual or a non-business entity. It includes the Petition for Refund of Tax form, the Statement of Facts form, and the Request for Hearing form. The Petition for Refund of Tax form must be completed and signed by the taxpayer. It includes information such as the taxpayer’s name, address, Social Security Number, and the amount of refund due. The Statement of Facts form must also be completed and signed by the taxpayer. This form is used to explain why the taxpayer believes he or she is entitled to a refund of taxes paid. The Request for Hearing form is used to request a hearing with the Tax Appeals Tribunal. The Business Packet is used to dispute a refund for a business entity. It includes the Petition for Refund of Tax form, the Statement of Facts form, the Business Tax Information form, the Business Information Verification form, and the Request for Hearing form. The Petition for Refund of Tax form must be completed and signed by a representative of the business entity. The Statement of Facts form must also be completed and signed by the business representative. The Business Tax Information form and the Business Information Verification form must both be completed and signed by the business representative to provide additional information about the business entity in order to verify its identity. The Request for Hearing form is used to request a hearing with the Tax Appeals Tribunal. Once all the necessary forms and information are completed and submitted, the New York State Department of Taxation and Finance will review the packet and contact the taxpayer if additional information is needed. If the packet is approved, a hearing will be scheduled with the Tax Appeals Tribunal.
